Help me find out how much my house is worth

Here are steps to get a reasonable idea of your house's worth:
  • Ask a Real-Estate Agent - they will typically meet with you in person and bring comparables with them to show you what your property is likely worth in the current market.
  • Use an Independent Appraiser - You can hire an appraiser to do an appraisal on your home.  The cost is usually around $400.00.
  • Search Online - This can be tricky though because there is a lot of misinformation out there.  The first two options will be more accurate.

Is September is the best time to purchase a home?

When is the best time of year to buy a home?

Its possible this September could be the best month all year to sign a contract to buy a home.
Why? Buyers will now have more choices than they have had for the past 10 months. According to realtor.com®, the single biggest factor holding back buyers from making a purchase all year long has been the inability to find a home that meets their needs. However, listings inventory on realtor.com has been growing all spring and summer, a pattern that continued into August. As of the third week in August, inventory was at 1.91 million units, up 3% from July and up 21% from January.

Normally inventory peaks in August and begins to slow as the nights grow longer. But this year the typical seasonal decline will start a bit later. There will be more choices in September than any other month in 2015.

The second factor is demand. Now that school has started, demand has already started to decline. With less competition for the most listings all year, pricing power weakens as inventory takes longer to sell.

The third, and final, factor: the current low level of mortgage rates. The average 30-year fixed rate touched 4.2% in June but has since pulled back and danced around 4%. Rates are likely to be closer to that June peak by the end of the year. So signing a contract to buy a home soon would enable buyers to lock in today’s lower rates before they start their long-awaited ascent.

Part 3: Risk elimination and title insurance

An important part of title insurance is its emphasis on risk elimination before insuring to provide the insured the best possible chance for avoiding title claim and loss. 

Insuring title begins with a search of public land records for matters affecting the title to property. Examination of evidence from a search is intended to report all material objections to the title. Frequently, instruments that don't clearly pass title are found in the chain, or history, of ownership assembled from the records in a search. These need to be corrected before a clear title can be conveyed. Examples of instruments that can present concerns are as follows:
  • Deeds, wills and trusts that contain improper entitlement and/or incorrect names
  • Outstanding mortgages, judgments and tax liens
  • Easements
  • Incorrect notary acknowledgements

City of Chicago provides resources to help keep residents safe during extreme heat

On July 17, 2015, The Chicago Department of Public Health (CDPH) and Department of Family and Support Services (DFSS) reminded residents to be aware of extreme temperatures and to be sure to take the necessary precautions to avoid heat-related emergencies. Residents are urged to call 311 for well-being checks, and to check in on neighbors and seniors.

To Prevent Heat Related Illness:
  • Keep your body cool. Take cool showers or baths if necessary.
  • Stay in air conditioned buildings as much as possible. If you don’t have access to air conditioning, call 311 to find the nearest cooling center. DO NOT rely on a fan as your primary cooling source.
  • Be sure to monitor weather forecasts so you can plan your activities safely when it’s hot outside. Avoid going out in the heat during the hottest part of the day.
  • If you do go out, wear light, loose-fitting clothing---and wear a hat to protect your head. Use sunscreen and reapply as directed on the package. If you’re exercising or working outside, pace yourself and drink more water than usual and don’t wait until you are thirsty to drink more. If possible, take breaks to cool off in an air conditioned room and always have a partner with you.
  • NEVER leave infants or children in a parked car. Nor should pets be left in parked cars—they can suffer heat-related illness too.
  • Check on your relatives, friends and neighbors and share these tips with them. The elderly, those who live alone, those who are ill and young children are most vulnerable to extreme heat and humidity.
Resources Available to Keep Safe and Cool:
  • DFSS coordinates the operation of cooling centers, provides transportation to them and conducts well-being checks on at-risk residents, including seniors.
  • The Garfield Center, located at 10 S. Kedzie, is available 24 hours a day, seven days a week to connect residents to emergency shelter.
  • In addition, the King Center (4314 S Cottage Grove) and North Area Center (845 W. Wilson) will be open as cooling centers from 10:00 a.m. to 5:00 p.m.
  • Additional city facilities including libraries, police stations or other structures might be made available after hours, on weekends, or on holidays, as conditions warrant.
  • Seniors or individuals with limited mobility may call 311 to request transport to the nearest cooling center.

The economy

On July 21, 2015, the Chicago Association of Realtors reported the following information regarding the City of Chicago statistics:

"With the economy on the ups these days, the Federal Reserve Chair, Janet Yellen, is predicting a fine-tuning of monetary policy by the end of the year. In tandem with the improving economy, the unemployment rate dropped by 0.2 percent to 5.3 percent for June 2015. It is widely believed that interest rates will go up before the year is over, which is a pretty clear indicator that the housing market is thrumming along at a good clip."

When is your first mortgage payment due?

Unlike rent, which is paid one month in advance, a mortgage payment is made in arrears which means that each mortgage payment covers principal repayment and mortgage interest for the month preceding the payment due date.

After closing, your first mortgage payment comes due one full month after the last day of the month in which your mortgage closed. For example if you close on June 16,2015, your first mortgage payment is due on August 1. At closing you will be paying the accrued interest from the date you close,June 16th to the last day of that month or June 30th.

Home appraisals

When selling or refinancing a home, a professional home appraisal is required. The unbiased opinion of your properties value gives potential buyers and lenders a clear picture of it's worth. The process has three major steps:

Real Estate Inspection: The appraiser closely examines the interior and exterior of your home, taking photos and noting its overall condition.

What is the difference between a contingent and pending home listing?

A home listing that is contingent means that the listing is still considered active in the multiple listing service but an offer has been made and accepted. 

The contingent nature of the listing is the numerous steps that a tentative purchase goes through, such as an attorney review, securing a mortgage and a home inspection. Realtors often show homes while a listing is contingent, just in case the offer falls through. However, some buyers write a "no showing" clause into their offers.

A home listing that is pending means all the contingency steps have been completed and the transaction is about to close. Pending listings are not considered active and the property is no longer shown.

Is there a difference between the loan balance and the loan payoff?

Yes, the loan balance does not equal the loan payoff. Your monthly mortgage statement includes a loan balance amount which does not include any of the mortgage interest that's accrued since that last statement. The payoff amount changes daily and when selling your home you will need to know the payoff amount.

What is "Market time"

Market time is the number of days since a home was initially listed for sale. Market time incorporates price changes.  In some cases, homes can be taken off the market and then relisted as a new listing. In the Chicago area's multiple listing service, if a home is off the market for more than 90 days and then comes back on, it's considered a new listing.

It should be noted that a home can return to the market at the same price for various reasons. Two of the most frequent are because a potential buyer was unable to secure financing or due to issues that were found during a home inspection.

Seller timelines

Although every transaction can be different, this is a general timeline from the seller's point of view.

1. Offer. There is an offer for the property. Your realtor receives earnest money from the buyer.

2. Attorney involvement. When you receive an offer (or even before) you should immediately call Bradford Miller Law and fax or email the contract to our office. It is important to get the attorney involved right away because there are deadlines that begin to run.

3. Attorney review, etc. We will then begin his or her work on the transaction that will include reviewing the terms of the contract, ordering and reviewing the title policy, and drafting the paperwork necessary for closing.

4. Inspection deadline. In a typical contract, the buyer has the right to have the property professionally inspected. If any problems are found, the buyer may ask for them to be repaired or they may ask for a monetary credit. Or they could choose to cancel the contract and have the earnest money returned to them.

5. Money into escrow account. At some point, usually after the attorneys have come to an agreement on all terms, the buyer will give an additional amount of earnest money. This money typically goes to your realtor's office who then puts it into an escrow account.

6. Mortgage commitment deadline. This is often the deadline that matters the most to all of the parties. For a buyer that needs to take out a mortgage, this is the deadline where the lender either "commits" to lending money for the property or decides they cannot lend money for this property. Often, this deadline needs to be extended because the lenders have become more cautious then before and therefore need more time.

7. Final walk-through. The final walk-through takes place, usually the day before the closing.

8. Closing. The actual closing takes place which is where everyone signs the paperwork and keys are exchanged.

Overall, the above timeline typically takes around 45-60 days to complete but every transaction is different and sometimes deadlines need to be extended for one reason or another. "As is" listings

Selling a property "as is" has become more common particularly with foreclosures and short sale transactions. This may make potential buyers hesitant but it simply can mean that the sellers just do not have the time or money to pay for some needed repairs.

Sellers and contingencies

There are many legal issues that can affect selling your home. Once both parties reach an agreement and signs a contract, certain contingencies must be preformed. Typically in Chicago, there are three standard contingencies that protect both parties.

First, the financing contingency. With this contingency, a buyer needs to obtain a loan before the sale is final. The buyer is not required to go through with the sale, if they cannot secure a loan.

Second, an inspection contingency. This contingency specifies that the property is inspected to the buyer's approval. Making repairs prior to listing your home can be highly beneficial. If the house needs a lot of repairs, buyers might gain the upper hand in negations, causing you the seller to settle on a lower price or it can allow buyers to remove themselves from the transaction if there is an excessive amount of flaws found with the property.

And, third, the attorney review contingency. In this contingency, both the seller's and buyer's attorneys review the contract.

Sellers and property taxes in Cook County

In Cook County we pay our property taxes in arrears, which means that in 2015, we are paying 2014 taxes. Therefore, when you sell your home, you will have to give a credit to the buyer for the taxes not yet due while you lived in the home. Generally speaking, taxes are prorated around 105-110 percent absent special circumstances. That means that we are assuming that the taxes will go up 5-10 percent next year.

Redfin Realty reported that the following five Chicagoland neighborhoods were the hottest neighborhoods for 2015:

Garfield Ridge
Brighton Park
Lakeshore Historic District (Evanston)
Ishnala (Palos Heights)

Redfin says its report was calculated by measuring which areas had the highest increase in total page views, favorites and Hot Homes on its website and apps over the course of 2014. They say that those neighborhoods that experienced the most growth in these metrics are projected to show increased transactions and prices in 2015.

Loan changes aimed at keeping properties from forclosure

Mary Ellen Podmolik of the Chicago Tribune reported the following article on April 14, 2015:

"With Chicago and suburban Cook County still one of the markets hardest hit by the housing crisis, Fannie Mae and Freddie Mac are rolling out another loan modification program to try and keep some of those properties out of foreclosure.

The Federal Housing Finance Agency, which oversees Fannie Mae and Freddie Mac, estimates that as many as 18,000 borrowers who are at least 90 days or more behind on their mortgage payments may be eligible for the MyCity Modification program.

Mortgage servicers have already been directed to reach out to delinquent borrowers in Cook County for the program if they have a mortgage backed by Fannie Mae or Freddie Mac and the current market value of the property is $250,000 or less. A borrower who defaulted on a previous modification through the federal government's Home Affordable Modification Program still can be considered for the program.

The goal of the modifications is to reduce a borrower's monthly mortgage payment by up to 60 percent by cutting the mortgage's interest rate to as little as 2 percent, extending the length of the loan and deferring part of the unpaid principal balance.

The rollout of the program comes as the number of seriously delinquent loans in the Chicago area continues to fall from its year-ago levels but remains higher than the national average. In February, 5.7 percent of homes with a mortgage in the Chicago area were at least 90 days behind on mortgage payments, according to housing research provider CoreLogic. That compares with 4 percent nationally."

Millennials won't sacrifice details

The National Association of Home Builders (NAHB) reported that as Millennials begin to enter the home buying market, smaller homes will be desirable, laundry rooms will be essential, and home technology will become increasingly prevalent. They reported that top features of a home have to do with energy efficiency such as Low-E windows, Energy Star-rated appliances and programmable thermostats. The top features include a master bedroom walk-in closet and a separate laundry room. Storage is also important, with linen closets, a walk-in pantry and garage storage. Because they generally don’t have as much ready cash–or free time–as older home owners, Millennials are also seeking less expensive, low-maintenance choices like a brightly painted front door, strings of garden lights, and landscaping that needs less watering and mowing, and larger patios.

Two trends were also reported that play into home buying and home renovation decisions. Emphasis on the importance of outdoor living and that generation’s seamless use of technology. Since millennials are very comfortable with their smartphones and tablets, they increasingly seek ways to control their heating, air-conditioning, security and lighting as well as electronics like televisions and sound systems from their phones.

Default & Delinquency

Default: 
Failure to fulfill a legal obligation. A default includes failure to pay on a financial obligation such as not paying your mortgage. It may also be a failure to perform some action or service that is non-monetary like having a tenant that is not properly maintaining a property, they may be in default of the lease.

Delinquency:
Failure to make a payment when it is due. The condition of a loan when a scheduled payment has not been received by the due date, but generally used to refer to a loan for which payment is 30 or more days past due.
