Repairs before selling

If the buyer asks for certain repairs to be made during the inspection period, does the seller have to comply? No, you do not need to comply. Keep in mind, however, that the buyer could then possibly walk away without penalty. Sellers, it is a good idea to interview potential real estate agents

If you will be using an agent to sell your property it's a good idea to interview several agents before you sign a listing agreement. Here are a few things you should be asking:
  • Ask for their advice, what would they highlight about your home? What would they change before it goes on the market?
  • Ask to see an activity list of the buyers and sellers they've represented, the areas of town and the price ranges. You do not want private details, but you want to see if they've worked in your neighborhood, in your price range and if they have a track record of successful sales.
  • Ask how old the comparable sales "comps" that they are showing you? A few years ago, you could study comps that were 6 months old. Now, because many markets are changing, you want neighborhood comps that are no more than two to three months old.
  • And, find out how long each has been a professional. Experience counts.

Sellers should you get your house inspected?

Some real estate agents advise against spending the money because buyers usually will get one anyway prior to closing. Others recommend it, because it gives sellers an early warning on any repairs they might have to make. Being proactive does have it's advantages. This way you will know ahead of time what problems the inspector uncovered and you can either fix them before you put your house on the market or know what to expect if the buyer wants to negotiate when they submit an offer on your property. Knowing ahead of time also allows you to shop around for the best price instead of perhaps paying an inflated price later on just to close the deal.

What is amortization?

Amortization refers to the process of paying off a debt, often from a loan or mortgage over time through regular scheduled payments. A portion of every payment is applied towards both the interest and the principal balance of the loan. The exact amount applied to principal each time varies, with the remainder going to interest. An amortization schedule reveals the specific amounts put towards the interest and the principal balance, with each payment. Initially, a large portion of each payment is devoted to interest. As the loan matures, larger portions go towards paying down the principal.

POLL: REAL ESTATE HEADING IN RIGHT DIRECTION

Frederic Scovell, a Coldwell Banker Residential Broker recently reported the following article: 


In a recent Gallup poll, Americans were asked to rate 24 different business sectors and industries on a five-point scale ranging from "very positive" to "very negative." The poll was first conducted in 2001, and has been used as an indicator of "Americans' overall attitudes toward each industry".

For the first time since 2006, Americans had an overall positive view of real estate, giving the industry a 12% positive ranking.


Americans' view of the real estate industry worsened from 2003 to the -40% plummet of 2008.  Gallup offers some insight into the reason for decline:

Prices Dropped

"In late 2006, real estate prices in the U.S. began falling rapidly, and continued to drop. Many homeowners saw their home values plummet, likely contributing to real estate's image taking a hard hit."

Housing Bubble

"The large drops in the positive images of banking and real estate in 2008 and 2009 reflect both industries' close ties to the recession, which was precipitated in large part because of the mortgage-related housing bubble."

Bottom Line

"Although the image of real estate remains below the average of 24 industries Gallup has tracked, the sharp recovery from previous extreme low points suggests it is heading in the right direction."

Surveys, Encroachments and Easements

A survey is a precise measurement of a property by a licensed surveyor, showing legal boundaries of a property and the dimensions and location of improvements. A survey will show the boundaries of your property, and whether there are any encroachments. 

An encroachment is the intrusion onto property without right or permission. Such as a fence that is on the other side of your property (or inside, for that matter).

A survey should also indicate whether there are any easements of which you should be aware. An easement is the right to the use of, or access to, land owned by another. Typically, utilities and cable companies may have an easement so that they can repair pipes, wires, etc. on your property.

At a time when you’re already spending a lot of money, a survey can seem like a big expense. However, it’s far better to be aware of any issues before you buy a house so that you can make an informed decision about how much you’re willing to pay for it and, if necessary, budget or negotiate with the seller for any repair work that is needed. Most lenders require a survey but, if they do not it is still a very good idea to obtain one.

What kind of "closing costs" can a seller expect?

Most real estate attorneys consider Realtor commissions, taxes, title related fees, etc. all to be "closing costs." Others may only call title-related fees "closing costs."

For sellers, the largest closing cost tends to be the Realtor commission. This commission is typically between 4 percent and 6 percent of the sale price. The next largest cost is real estate property taxes. In Cook County, we pay property taxes in arrears — which means that this year, we are paying the last year's property taxes. So when you sell your home, you must give a property tax credit to the buyer for the taxes not yet due while you were still living in the home. This property tax credit can be negotiated and a formula is used to calculate the actual amount. The remaining costs include title-related fees, city, county and state taxes.

Overall, in a typical transaction, sellers can expect to pay around 8 percent of the sale price in total closing costs. This includes a 5 percent Realtor commission, taxes and title-related fees. For example, on a $200,000 home, the seller can expect to pay around $16,000 in total closing costs. Again, each transaction is different, and if no Realtors are involved, the closing costs will be much lower because there will be no commissions to pay.

Another way to look at it would be to add 3 percent to the Realtor commission. The Realtor commission will be stated on the listing agreement that you signed when you put your home up for sale.

Required loan documentation

To insure that your home buying experience goes smoothly, it will be helpful to have the following paperwork ready to present to the lender. You may also need additional documentation but this is a good start.

Income verification-you must prove that you have a regular, reliable source of income. Pay stubs, bank account information, W-2 forms, 1099 forms if you are self employed and if you’re retired proof of Social Security income and an accounting of your retirement assets.

Tax transcripts-most mortgage applications require you to provide two years of tax transcripts, not the 1040 form you filed. A tax transcript is the record that gets created when the IRS processes your return. Visit www.irs.gov to obtain these documents.

Credit history-most lenders will run a credit check and will ask you about your credit card history along with any loans such as car and student loans. Have all this information ready including account numbers.

Proof that you pay your bills-lenders want to see how you handle your bills. Many times they will ask you to prove your payment history. If you’re currently a renter, you might need to supply up to a year’s worth of rent receipts, as well as the contact information for your landlord. They may also ask for utility bills, credit card statements, insurance payments and other recurring bill.

Down payment money-where did it come from? If not from your own savings, sometimes the money comes from a family member. If so, the lender  needs to know if it is a gift or a loan. If it is a loan, it will be counted as a debt. If it is a gift, you will need a letter stating that the money does not need to be paid back.

Selling your home in winter or early spring

Redfin, a real estate brokerage recently looked at home sales from 2011 to 2013 and found that homes listed between December 21 and March 21 sold one week faster and for slightly more on average than any other season. This goes against the conventional wisdom that spring is the best time to sell your home. They also found that listing your home on a Thursday or Friday, so you are fresh in people’s minds when they’re making plans with their agent to go see homes on the weekend sell closer to their original list price and have the best chance of selling.

What is a HUD and what does HUD stand for?

HUD: Housing and Urban Development. A U.S. government agency established to implement federal housing, community development programs and oversee the Federal Housing Administration.

HUD-1 Settlement Statement: A final listing of the costs of the mortgage transaction. It provides the sales price, down payment amount, as well as the total settlement costs required from the buyer and seller. Also known as a closing statement.  The Sellers Attorney is responsible for preparing this document.

Don't make these mistakes!

When you sell your home, it pays to do everything right. By avoiding these few common mistakes, you may save yourself money in the long run:
  • Not making necessary repairs. Chances are you will lose money if you do not take care of those necessary repairs before the house goes on the market. You do not want potential buyers to see your house in disrepair this will affect their offer price.
  • Refusing to remove clutter. One of the easiest improvements you can make to your home is to create a sense of spaciousness. Declutter those kitchen counter tops, overstuffed closets, garage and storage shelves.  
  • Selling an empty house. Selling an empty house is not advisable, homes should be staged.  It makes your house feel more inviting, talk to your Realtor for more information on staging.

City of Chicago, Share the Warmth program

Mayor Rahm Emanuel and Peoples Gas announced on October 20, 2014 a doubling of funding for Share the Warmth, a financial assistance program that helps low-income families pay their heating bills. This winter, the City and Peoples will provide $1 million in funding for the Share the Warmth program, enough to assist 5,000 families with their heating bills.

Share the Warmth provides heating grants to limited and fixed-income households. Eligible customers who make a payment towards their bill receive a matching grant of up to $200. Grants can be used to reconnect service, avoid disconnection and maintain a home’s natural gas service.

The City and Peoples Gas have agreed to double the size of Share the Warmth funding as compared to donations from the previous year. This year, the City will contribute $100,000 to the program while Peoples Gas, its customers and employees will donate the remaining $900,000.

Share the Warmth opens for enrollment on Wednesday, Oct. 23. Priority groups, including seniors (60+), people with disabilities and households with children under five, are also able to apply for the Low Income Home Energy Assistance Program (LIHEAP) at this time. General enrollment for LIHEAP begins on Nov. 1. Both programs are administered by the Community and Economic Development Association (CEDA). Illinois utility customers have access to more than $150 million in heating and home energy assistance funds this winter.

City of Chicago Residential Garage Demolition Program

The City of Chicago, Department of Buildings has developed an efficient process for wrecking residential garages.  When a garage needs to be removed and will not be rebuilt, the city will issue a permit with an Easy Permit Application. Requirements for this permit include:
  • An Easy Permit Application completely filled out with the owner’s signature and the garage dimensions.  The Property Index Number (PIN) must also appear on the application.
  • A signed contract between both owner and contractor detailing the scope of work; and including the stipulation that all debris will be removed from the site and disposed of at a proper facility.
  • Interior and exterior pictures of the existing garage.
  • No sign offs will be required from any other department, except from the Department of Water Management.When plumbing piping is supplied to the garage a B-Permit (to disconnect water) is required from the Department of Water Management. Water supply must be disconnected by a licensed and bonded plumbing contractor.
  • This type of permit will only be issued with a licensed General Contractor, Wrecking Contractor or Garage Company.  The fees will be $125.00.

Chicago Named Most Popular Metro Area For Families

On September 12, 2014, Mayor Rahm Emanuel announced that Chicago has been named the most popular metro area for U.S. families to move to. This was based on data collected from United Van Lines in its Summer Long-Distance Moving Trends Study.

"United’s survey shows that our efforts to build the Chicago of tomorrow by investing in a diverse and highly educated workforce and recruitment of new businesses are having an impact,” said Mayor Emanuel. “Chicago’s population is growing, our tech and healthcare sectors are thriving, and we continue to build out our legacy financial and professional service industries, all the while focusing resources on neighborhoods across the City to ensure that all Chicago residents have access to the benefits that this economic growth provides.”

Mayor Emanuel announced that 99 companies have opened offices and 27 companies have chosen to locate corporate headquarters in Chicago since he took office. Earlier this year, Site Selection Magazine named Chicago the top metro in North America for corporate relocations. In 2013, the City added more than 5,800 residents, the third consecutive year of population growth and a reversal of more than a decade of population decline.

Why Hire a Realtor?

Ron Rashid, a Coldwell Banker Residential Broker recently provided me with information as to why it's important to hire a Realtor. He states that many home buyers and sellers often wonder why they should hire a Realtor since there is so much data on the Internet. Home ownership's impact on net worth

Frederic Scovell, a Coldwell Banker Residential Broker recently reported the following article: 
"Over the last six years, homeownership has lost some of its allure as a financial investment. As homeowners suffered through the housing bust, more and more began to question whether owning a home was truly a good way to build wealth. A study by the Federal Reserve formally answered this question.

Some of the findings revealed in their report:
  • The average American family has a net worth of $77,300
  • Of that net worth, 61.4% ($47,500) of it is in home equity
  • A homeowner’s net worth is over thirty times greater than that of a renter
  • The average homeowner has a net worth of $174,500 while the average net worth of a renter is $5,100


Bottom Line

The Fed study found that homeownership is still a great way for a family to build wealth in America.

How did the Chicagoland August market do?

Phillip Buoscio, A Better Living Realty Broker published an article titled "August Market Update." Phil found that one of the biggest shifts that he has observed this year in the market is that traditional sales are finally starting to make a comeback.  Phil provided the following  the graph below, showing that traditional sales have jumped from their 3 year low in the spring of 2013 by almost 40,000.

Phil also found that on the other hand the inventory of distressed sales has continually declined over a similar time frame traditional listings have increased. Short sale listings have dropped 43% from its peak.  And REO (bank owned listings) have dropped 14%. Check out the graphs below.



Phil states that while the level of traditional sales vs distressed sales is still not typical of a "normal" market, things are improving.  The overall inventory in this region is still staying relatively low as well.  The result of this has been appreciation for most of the Chicagoland real estate market. While not all specific areas have seen appreciation necessarily, it's definitely a good sign for the overall health of the Chicago real estate market.

Phil advises that if you have been waiting to sell because you're not sure if you have any equity if your home, now is the time to check in on your value. Just like completing an annual physical for your health or annual review of your retirement accounts, it's always a good idea to track your home value.  For certain areas this fall may be the perfect time to sell.  For other areas it might be best to wait for the spring and start to prepare your house for the spring market now.  The best way to find out though is to have a complete market analysis on your property.

Let's talk about Escrow

Purchasing or selling real estate may be one of the biggest projects you ever undertake. It involves a lot of legal details, and real estate law is always changing. It's a good idea to talk with an experienced real estate lawyer to be sure you meet all the state's requirements. You can make the process a little easier by taking a few moments to learn a little about how it works. Here is some information about escrow.

Escrow: An item of value, money, or documents deposited with a third party to be delivered upon the fulfillment of a condition. For example, the deposit by a borrower with the lender of funds to pay taxes and insurance premiums when they become due, or the deposit of funds or documents with an attorney or escrow agent to be disbursed upon the closing of a sale of real estate.

Escrow Account: An account that a mortgage servicer establishes on behalf of a borrower to pay taxes, insurance premiums, or other charges when they are due. Sometimes referred to as an "impound" or "reserve" account.

Escrow Analysis: The accounting that a mortgage servicer performs to determine the appropriate balances for the escrow account, compute the borrower's monthly escrow payments, and determine whether any shortages, surpluses or deficiencies exist in the account.

10 important points to remember about short sales

1) They take time. On average, short sales take three months. But it depends on the lender. I have had some properties close in one month.

2) The seller will need to prove a financial hardship in order for the bank to consider the short sale. If you have a lot of money sitting in your checking account and are just looking for the lender to take the loss on the property, a short sale is not for you. Through our office and your real estate agent, we will provide the necessary paperwork for the lender to consider your financial hardship. In my experience, lenders have been very responsive to the financial hardships of sellers and will likely agree that a short sale is the best option.

3) The seller typically receives no proceeds from the sale; however, my office can sometimes get "relocation assistance" funds for the homeowner. The bank pays all customary closing costs such as agent commissions, taxes, title fees and attorney's fees.

4) All real estate sales contracts should use the appropriate short sale rider.

5) The seller must still accept an offer; however, it will be subject to lender acceptance. In other words, the lender must approve the terms of the offer as well as sign off on the seller's financial hardship circumstances.

6) There is no guarantee the bank will approve the sale; however, my office has a high success rate.

7) When an offer is presented, the bank will do its own research on the property by ordering a brokers price opinion ("BPO"). This is similar to an appraisal. Therefore, if the offers are lower than what other homes have been selling for, the lender may reject the short sale or counter at a higher price.

8) It is very important that the seller, listing agent and our office work together. This will ensure that the process goes as smoothly as possible.

9) Sellers should use a real estate agent and attorney who are experienced with short sales.

10) Sellers should get our office involved immediately. If you have stopped making your mortgage payments, call us right away to get started on a short sale. Purchase and Sale Agreement: A document that details the price and conditions for a transaction. Offers explained

Offer: A formal bid from the home buyer to the home seller to purchase a home. The offer should be in writing. You may choose to accept or reject this offer for any reason that is not discriminatory (race, age, etc.) or submit a counteroffer changing any terms you do not like.

Counter-offer: An offer made in response to a previous offer. For example, after the buyer presents their first offer, the seller may make a counter-offer with a slightly higher sale price.

Once the seller and buyer agree to all terms of the offer you will have a ratified sales contract which will include sales contingencies, such as obtaining a mortgage of a certain type and rate, getting an acceptable inspection, making repairs, closing by a certain date, etc.

Closing information

Closing: The process of completing a financial transaction. For mortgage loans, the process of signing mortgage documents, disbursing funds, and, if applicable, transferring ownership of the property. In some jurisdictions, closing is referred to as "escrow," a process by which a buyer and seller deliver legal documents to a third party who completes the transaction in accordance with their instructions.

Closing Costs: The fees charged in connection with a mortgage loan transaction. Money paid by a buyer (and/or seller or other third party, if applicable) to effect the closing of a mortgage loan, generally including, but not limited to a loan origination fee, title examination and insurance, survey, attorney's fee, and prepaid items, such as escrow deposits for taxes and insurance. Closing Date: The date on which the sale of a property is to be finalized and a loan transaction completed.

What is a contingency?

Contingency:
A condition that must be met before a contract is legally binding.

For example, home purchasers often include a home inspection contingency; the sales contract is not binding unless and until the purchaser has the home inspected. Your real estate contract will most likely contain contingencies. These items must be cleared up before the contract can be finalized. However, some buyers may want the contract nullified for certain defects. If you can't agree, the contract can be canceled.

Final walk-throughs

A final walk-through is an inspection of the property that you are purchasing. The inspection is performed anywhere from a few hours to five days before the closing. This inspection is performed so the buyer can make certain that the property is in the same condition as it was when they agreed to buy it, that the agreed upon repairs, if any, were made and to check that nothing has gone wrong with the property since the last time they saw it. A final walk-through is not a home inspection. This is not the time to begin negotiations with the seller to do repairs, nor is it a contingency. It is never a good idea to forgo the final walk-through.

Foreclosure activity report

On August 14, 2014, Mary Ellen Podmolik, Chicago Tribune reporter published an article titled "Foreclosure activity continues to fall in Chicago area, U.S."

She reported that foreclosure activity in the Chicago area decreased in July but the state continues to have one of the highest foreclosure rates in the nation. In an area that stretches from Kenosha, Wisconsin to Northwest Indiana, 6,572 homes received a foreclosure notice last month, RealtyTrac said. Foreclosure proceedings were started against 2,267 properties, while a court-supervised foreclosure auction was scheduled on another 2,516 homes. Banks repossessed 1,789 properties. The overall level of activity is down 12 percent from June and 7 percent from July 2013. Still, Illinois had the 4th highest foreclosure rate last month.

Banks are usually much more interested in facilitating short sales which avoid costly foreclosures. And, short sales allow you to repair your credit sooner than if you went through a foreclosure.

Cook County property and recording fraud

Property and recording fraud is one of the fastest growing white collar crimes. Fraudsters often target paid-for homes that have no mortgage, usually owned by an elderly person who may have no heirs, and file forged ownership documents with a County Recorder.

Once the document is recorded, it is up to the homeowner to petition the court, at their own expense, to get a court order to have the fraudulent recording removed. Selling the home or trying to obtain a mortgage or a refinancing can be impossible until the fraud issue is resolved.

More homeowners are becoming landlords

On June 17, 2014, Les Christie of CNN Money reported an article titled  "More homeowners becoming landlords" The article states in part that low mortgage rates and soaring rents have convinced a growing number of homeowners to hang onto their former homes and become landlords instead.

Reports show that 19% of current homeowners either purchased or refinanced homes between 2011 and 2013, when rates were historically low falling just below 3.4%. The math works in most landlords' favor these days. Rents have risen by about 20% nationwide since mid-2006, the housing bubble peak, while home prices are still about 21% below what they were at that time. For people who are still underwater on their mortgages and unable to profit from a sale, renting helps soften the blow.

Disconnect your downspouts to prevent basement sewage backup

The City of Chicago was the first major metropolitan area in the country to successfully implement an inlet control system to relieve basement flooding. The system works by installing valves to slow the flow of storm water into the sewer system. Storm water is detained on city streets for brief periods before flowing back into the sewer system. This measure helps relieve the burden on the sewer system and reduce the frequency of basement flooding and combined sewer overflows into the waterways.

The effectiveness of the inlet control system depends on the number of roof downspouts that are disconnected from the sewer system. While impractical in some places (where there are only hard surfaces or where drainage could impact neighboring property), the potential to reduce basement flooding and increase natural infiltration is great.

The City actively encourages homeowners to disconnect their downspouts from the sewer system and direct the water instead to their yards or gardens. Downspout disconnection can help prevent basement sewage backup. Before you disconnect your downspout, consider where you are directing the water, and that cold weather will cause icing conditions. When you are completed, your project should be a permanent solution which is beneficial to your grass, flowers, shrubbery and trees. Important Things to Remember:
  • Direct Downspout extensions towards the street or alley to prevent seepage into building foundations or adjacent properties. 
  • Firmly anchored splash blocks should be installed if downspout drainage is to travel over landscaping or dirt.  
  • Do not allow water to splash or pond on adjacent private property. 
  • Make sure downspout extensions end at least three feet away from basement foundations, and water is being directed on ground that slopes away (downward) from your building.

  • Kitchen:  Aromas from fragrant goodies like freshly baked gingerbread or just-brewed coffee bring back wonderful memories of home.

  • Painting:  Touch up your house’s exterior paint before you put it on the market. Paint and/or clean the front door.
  • Lawn:  Keep your lawn freshly mowed and neatly trimmed.
  • Sidewalks:  Sweep your sidewalks daily.
  • Shrubbery: Remove or replace any dead or dying trees, hedges, or shrubs; prune anything that looks unsightly or overgrown.
  • Flowers: Filling flowerbeds with seasonal flowers is an inexpensive way to add color and charm to your property.
  • Repairs:  Be sure that all gutters and downspouts are in place and clean. Replace missing roof shingles and broken or cracked windows.
